🔐 Power of Attorney & Legal Tools for Peace of Mind

By The Primary Health Awareness Trust | Helping you prepare for the future with clarity and control

Why Legal Planning Matters

As we age or face serious illness, it’s essential to prepare legal tools that protect our decisions—even if we lose the ability to speak or act for ourselves. These tools provide clarity, reduce stress for loved ones, and ensure your voice is heard.

In the UK, the most powerful way to do this is through a Lasting Power of Attorney (LPA).

What Is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) is a legal document that lets you appoint someone you trust to make decisions on your behalf if you lose mental capacity.

There are two types:

  • 🧠 Health and Welfare LPA: decisions about care, medical treatment, living arrangements, and end-of-life wishes.
  • 💷 Property and Financial Affairs LPA: decisions about money, bills, pensions, and property.

Who Should You Choose?

Your attorney should be someone:

  • ✅ You trust deeply
  • ✅ Who understands your values
  • ✅ Who is capable of acting responsibly under pressure

Many people choose an adult child, close friend, or spouse. You can appoint more than one person, either jointly or separately.

How Do You Make an LPA?

  1. Go to GOV.UK: Make a Lasting Power of Attorney
  2. Fill out the online or paper forms
  3. Have it signed by a certificate provider (a professional or someone who knows you well)
  4. Post the forms to the Office of the Public Guardian with the fee (£82 per LPA, reduced if on low income)

Once registered, your LPA is ready to use if needed—but it only activates for health decisions when you lose capacity.

Other Important Legal Tools

  • ✍️ Will: Ensures your money, property, and possessions go where you choose.
  • 📑 Advance Decision to Refuse Treatment (ADRT): A legally binding refusal of specific treatments under certain conditions.
  • 📁 Advance Statement: A written record of your personal wishes and beliefs (not legally binding, but useful).

These tools work alongside your Advance Care Plan and DNAR decisions to form a complete picture of your preferences.

What Happens Without Legal Planning?

If you become unable to make decisions and haven’t appointed an attorney:

  • ⚠️ Loved ones may need to apply to the Court of Protection (a long and costly process)
  • ⚠️ Decisions could be made by strangers or systems unfamiliar with your values

Taking control now reduces risk, confusion, and family disagreements later.

🧠 Surprise AI Prompt: Who Do You Trust With Your Future?

Prompt:
“Make a list of 3–5 people you trust with key parts of your life: health, money, values, and legacy. Why do you trust them? What would you want them to honour if you couldn’t speak for yourself?”

This reflection can help you choose an attorney, write an advance statement, or start a conversation with your family.
